Probate Court April 24th A.D. 1863: In the matter of James Adams Will

Be it remembered that heretofore to wit: on the 5th day of December 1862, the last will and testament of James Adams late of Franklin County, Ohio: deceased (who died on the [blank] day of [blank] 1862) was produced in open Court and offered for probate: And thereupon appeared William B. Fitzgerald one of the subscribing witnesses to said will and in open Court was Sworn and on oath testified to the due execution of said will which testimony was reduced to writing, duly subscribed by said witness and filed with Said will and this cause was continued for the hearing of further testimony: And be it further remembered that on this the 24th day of April 1863 appeared in open Court Edward Fitzgerald the other subscribing witness to said will and was sworn, and on oath testified to the due execution of Said will which testimony was reduced to writing duly subscribed by said witness and filed with Said will: And in appearing to the Court by said testimony that said will was duly attested and executed and that said testator James Adams at the time of executing the same was of full age and of sound mind and memory and not under any restraint; Therefore it is ordered by the Court that said will be and hereby is admitted to probate and that the same together with the testimony so reduced to writing be recorded. Will I, James Adams, of the County of Franklin and the State of Ohio being of sound and disposing mind and considering the uncertainty of life do make this my last will and testament in manner following that is to say: 1st My will is that the expenses of my last sickness and funeral be first payed. 2nd That all just debts by me owing at the time of my decease 3rd That there be paid by my executors to each of my two daughters Priscilla Bradfield and Mary Spencer within eighteen months from the time of my decease the sum of one hundred and seventy five dollars each out of the land. 4th I give to my granddaughter Ida Ellen Lewis the sum of one hundred dollars to be paid to her at her marriage. 5th I give and bequest to my son William D. Adams the East half of my farm reserving to my son St. Clear Adams the right of way in and out and also the right to water. Beginning at the N.E. corner of said farm, thence S 20o E 76 poles to Stake, thence S 68o W 180 poles to a Stake, thence N 20o W 30 poles to a Stake, thence N 68o E 94 poles to a Stake, thence N 20o W 50 poles to a Stake, thence N 70o E 86 poles to the Beginning being about fifty four acres of land By his paying to each of his two Sisters Priscilla Bradfield and Mary Spencer the sum of eighty seven dollars and fifty cents and also the sum of fifty dollars to my granddaughter Ida Ellen Lewis at her marriage. 6th I give and bequeath to my son St. Clear Adams the west half of my farm Beginning at the North West corner of said farm thence S 76o E 115 poles to a Stake, thence S 20o E 50 poles to a Stake, thence [S] 68o W 94 poles to a Stake thence N 20oW 118 poles to the Beginning containing about fifty four acres of land by him paying to each of his sisters Priscilla Bradfield and Mary Spencer the sum of eighty seven dollars and fifty cents and to my granddaughter Ida Ellen Lewis the sum of fifty dollars at her marriage the above legacies to be paid out of the land aforesaid and should she die before marriage then the amount of her legacy to be equally divided between my two daughters Priscilla Bradfield and Mary Spencer. 7th The residue of my effect being principally in notes, rents and accounts I wish my executor to collect and pay my two daughters aforesaid the amount: Share and share alike. And lastly I do hereby constitute and appoint my son William D. Adams and Edwd Fitzgerald to be the executors of this my last will and testament revoking and annulling all former wills by me heretofore made ratifying and confirming this. Fitzgerald being duly sworn in open Court this fifth day of December A.D. 1862 depose and say that I was present at the execution of the last Will and Testament of James Adams deceased herewith annexed: That I saw said testator subscribe said will and hear him publish and declare the same to be his last Will and Testament; and that the said James Adams at the time of executing the same was of full age and of sound mind and memory and not under any restraint: And that I signed the same as a witness at his request and in his presence and in the presence of Edward Fitzgerald the other subscribing witness thereto.
