Will of John Ficklin, jr

In the name of Godd amen!
I John Ficklin knowung the uncertainty of human
life, do make this my last will and testament
1st I bequeath my soul to God and my body to
the dust.
2nd I will that all my just debts be paid and
after paying them and such bequests as shall
hereafter be made, that all my property be equally
divided between my eight children Katherine Stephens
Margaret Ficklin, Fanny Stevens & Charlotte Miller,
John, George, Clifton & Benjamin Ficklin.
3rd I desire the property that each of the married
children have be taken into account and equality be
preserved among them.
4th I desire that Malyrie Armstrong and Elizabeth
Onsley, the one of Sangamon Co., Illinois, the other
of Cass County, Missouri each receive one dollar.
5th I desire that my wife Judy Ficklin retain one
third of the property in her hands during her natural
lifetime; my desire is that the property be sold by
my executors and that the provisions of this will be
complied with.
I hereby appoint William L. Miller and Milton
Stevens my executors to this my last will and testament.
Done this 14th day of October 1858

Montgomery County}  December Term 1858
The writing purporting to be the last will and Testament
of John Ficklin Deceased, which was partly proved by the
Testimony of Jarrett Ficklin a witness thereto subscribed,
on the first day of the present term of this court and
continued until today for further proof; was this day
again produced in court and proved by the Testimony of
B. H. Graves another witness thereto subscribed to be the
act and deed of the said John Ficklin deceased; which will
was examined and approved by the court, and ordered to be
recorded, which is accordingly done.

Will of John Ficklin:

In the name of God Amen. I John ficklin of Jessamine County and State
of Kentucky being weak of Body but of Sound and perfect mind and memory
considering the uncertainty of this Mortal life and being of Sound &
blessed by almighty God for the same do make and publish this to be my
last Will and Testament in manner And form following viz, - First I
give and bequeath unto my Beloved Wife Mary Ficklin the plantation on
which I now live During her life and it is my will and desire that it
should not be sold by herself nor my children the legatees during her
life and should She Die before my younger children come of age it is
my will and Desire that it should be rented out for the Support and
maintainance and Education of my younger children - I Also leave my
beloved Wife the Stock that is on the farm and the Farming Utensils
and all things necessary and belonging to said farm. And it is my
desire that after my Wife's Decease and my younger children as before
Stated come of age that then and not before that period I wish an
equal division to take place of my Estate among my Children and my
Grandchild Patsy who lives with me that is my daughter Sally Payton's
child whom it is my will and choice that she should have her full and
equal part with my children herein named as follows viz, Jarrod
Ficklin, Betsy Hampton, John Ficklin, William Ficklin, Thomas Ficklin,
Lucky Ficklin, Charles Ficklin, Joel Fickin, Kelly Ficklin, Price
Ficklin, and Polly Ficklin and also my Daughter Sally Payton, her part
particularly is to her and to thr heirs of her Body in short I wish it
to be so fixed by my Executors herein names or their Counsel that my
daughter Sally Payton's Husband namely Benjamin Payton Shall not have
any access to her part or division of the Estate but be entirely
appropriated to her use and the heirs of her Body So that said Payton
may not if possible have it in his powers to get her division or part
and destroy it Moreover this is my will and desire with respect to my
Daughter Sally and her husband Benjamin Payton can it be legally
accomplished I also leave my beloved Wife Polly Ficklin Executrix
Together with my Son Jarrod Ficklin Exor of this my last Will and
Testament hereby revoking all former Wills by me made In witness
whereof I have hereunto set my hand and seal this 19th day of April 1819
