---------------------------------------------------------------------------- THE LAST WILL AND TESTAMENT OF PETER STOLP OF THE TOWN OF MARCELLUS IN THE COUNTY OF ONONDAGA AND STATE OF NEW YORK

I Peter Stolp considering the uncertainty of this mortal life and being of sound mind and memory (? be Almighty God for the same) do make and publish this my last will and testament in manner and form following ( that is to say) First I give and devise to my son George Stolp and his heirs the west half part or moiety of all that certain piece or parcel of land situate, situate lying and being in the aforesaid town of Marcellus, the same being part of lot number forty nine in said town bounded on the North by the state road, on the West by the highway, running from the said state road South; on the South by land now owned by George Christler and on the East by land now owned by my son William Stolp, to be divided by a line to be drawn through the center thereof from North to South to have and to hold (subject never the less to and charged and chargeable with the payments of the legacies or sums of money as hereinafter mentioned) with the appurtenances to him the said George and his heirs forever. Also I give and devise to my son William Stolp and his heirs the East half part of moiety of the aforesaid piece or parcel of land to be divided aforesaid to have and to hold with the appurtenances (Subject never the less to and charged and chargeable with the payment of the legacies or sums of money as hereinafter mentioned) to him the said William and his heirs forever. Also I give and bequeath unto my son Frederick the sum of two hundred dollars. One hundred dollars thereof payable in two years from and after my decease and the other hundred dollars thereof in seven years from and after my decease. One half of each of the said payments to be paid by my said sons George and William respectively out of the lands and and tenement herein before devised to them respectively. Also I give and bequeath unto my daughter Elizabeth the sum of two hundred dollars. One hundred dollars payable in three years from and after my decease, and the other hundred dollars in eight years therefrom and to be paid in the same manner by my said sons George and William as the aforesaid legacy or sum of money to my said son Frederick. Also I give and bequeath to my son Peter Stolp the sum of two hundred dollars. One hundred dollars payable in four years from and after my decease, and the other hundred dollars thereof in nine years from the time of my death and to be paid by the said George and William respectively in the same manner as the said legacy so given as aforesaid to my said son Frederick. Also I give and bequeath to my son Joseph Stolp the sum of two hundred dollars. One hundred dollars payable in five years and the other hundred dollars in ten years from and after my decease and by my said sons George and William respectively in the same manner as the said legacies herein before given as aforesaid. Also I give and bequeath to my son John Stolp the sum of two hundred dollars. One hundred dollars thereof payable in one year and the other hundred dollars in six years from and after my decease to be paid in like manner by the said George and William respectively as the said legacies herein before given on this express condition, however that my said son John do and share well and truly pay me or my executor herein after named the sum of two hundred and sixty dollars, or there abouts with the interest which is now justly due and owing to me from the said John, and I do hereby charge and subject the lands and tenements to respectively do owed as aforesaid to the said George and William to and with the payment of the said legation so given as aforesaid at the times and in the manner herein before specified. And finally all my personal estate whatsoever and wheresoever the same may be remaining after payment of my debt and funeral expenses I give and bequeath unto my before named children George, William, John, Frederick, Elizabeth,Peter and Joseph to be divided equally between them share and share alike. And I do hereby appoint my sons George and William Stolp executors of this my last will and testament hereby revoking all former wills by me made. In witness whereof I have here unto set my hand and seal this ninth day of February in the year of our Lord one thousand eigth hundred and twenty four.

Signed, Sealed Published and declared by the above named Peter Stolp to be his last will and testament in the presence of us who have hereunto subscribed our names as witnesses in the presence of the testator - John Bixby, Esekiel Baker and Joseph Baker

Onondaga County: Be it remembered that on the seventeenth day of October A.D.1826 personally appeared before Mr. Freeborn G. Jewette Surrogate of said County, Joseph Baker one of the subscribing witnesses to the will of Peter Stolp late of the town of Marcellus in said county deceased, who being duty sworn declared that he did see the said Peter Stolp deceased execute the annexed instrument purporting to be the last will and testament of the said Peter Stolp bearing date the ninth day of February in the year one thousand eight hundred and twenty four, that he heard him the said Peter publish & declare the same as and for his last will and testament that at the time thereof he the said Peter was of sound disposing mind and memory to the best knowledge and belief of him the said Joseph and that he together with John Bixby and Esekiel Baker the other subscribing witnesses to the said will did willingly subscribe their names as witnesses in the presence of the testator. In witness whereof the said surrogate hath hereto set his hand and affixes his seal of office Done at Skamateh this seventeenth day of October A.D. 1826

Onondaga County: Be it remembered that on the seventeenth day of October A.D.1826 peersonally appeared before Mr. Freeborn G. Jewett surrogate of said County, George Stolp, William Stolp and William Landers executors in the aforesaid will named and duly sworn to the faithful performance and execution thereof by taking the usual oath in that case provided.
